Terms of service

These terms govern your use of Gym Management Soft. By creating an account you agree to them. If you sign up on behalf of a gym or business, you confirm that you are authorised to accept these terms for it.

The service

Gym Management Soft is online software for managing a gym: members, plans, subscriptions, invoices, payment records, attendance, staff accounts and member notifications. We may improve or change features over time.

Accounts

• You must give accurate information and keep your login details safe.
• You are responsible for everything done through your gym’s accounts, including counter and trainer accounts you create.
• You must have the right to enter your members’ data and to send them messages through the service.

Fees and billing

• Signing up is free. The service costs $1 (USD) per active member for each 30-day billing cycle, counted from your sign-up date.
• An active member is a member with an active subscription at your gym during the billing cycle.
• At the end of each cycle we issue an invoice. Payment is due within 10 days.
• If an invoice is not paid within 10 days, we may pause access to your gym’s account (for you, your staff and your members) until it is paid. Your data is kept during a pause.
• We may change prices with at least 30 days’ notice by email. Changes apply from the next billing cycle.

Payments between you and your members

Gym Management Soft records payments that you collect from your members. We do not process, hold or guarantee those payments, and we take no fee from them. You are responsible for your own prices, taxes and receipts.

Acceptable use

You agree not to misuse the service, including by:

• sending spam or messages your members have not agreed to receive;
• uploading unlawful content or content you have no right to use;
• trying to access other gyms’ data, probe our systems or disrupt the service.

Your data

You own your gym’s data. We process it to provide the service as described in our privacy policy. You can ask us to export or delete it.

Cancelling

There is no contract. You can stop using the service at any time. Any invoice for a completed billing cycle remains payable. We may suspend or close accounts that break these terms.

Disclaimer and liability

The service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the fees you paid us in the three months before the claim.
